Terms and Conditions for ROCKIN' the BOAT

Welcome to ROCKIN' the BOAT. These Terms and Conditions ("Terms") govern your access to and use of the ROCKIN' the BOAT website located at https://www.rockintheboat.club/ (the "Site"), your membership in our travel community, and any services or merchandise provided by ROCKIN' the BOAT (collectively, the "Services").
By accessing the Site or joining our community, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or Services.
1.1 Eligibility: You must be at least 18 years of age (or the age of majority in your jurisdiction) to become a member of ROCKIN' the BOAT. By joining, you represent that you meet this requirement.
1.2 Membership Tiers: ROCKIN' the BOAT offers a free lifetime membership for the first 5,000 members who register through the Site. Once this limit is reached, ROCKIN' the BOAT reserves the right to implement membership fees or different access tiers at its sole discretion.
1.3 Account Responsibility: You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your membership.
1.4 Membership Cancellation: We reserve the right to suspend or cancel any membership (and restrict access to the Site, events, or other Services) if, in our reasonable judgment, you violate these Terms, any posted community rules, or engage in conduct that harms the community, ROCKIN' the BOAT, or other members.
2.1 User Conduct: ROCKIN' the BOAT is a community for cruise enthusiasts. We expect all members to treat others with respect. You agree not to post or transmit any content that is unlawful, threatening, abusive, defamatory, or otherwise objectionable.
2.2 Community Conduct (No Harassment or Spam): You agree not to harass, threaten, bully, stalk, impersonate, or intimidate others, and not to post or distribute spam, scams, or unwanted solicitations. This applies across our community spaces, including local city events, live streams, comments, chats, and any other member interactions. We may remove content, restrict participation, or suspend/cancel memberships for violations.
2.3 Social Media and YouTube Interaction: Our community integrates with YouTube and other social media platforms. By participating in live streams, commenting on videos, or engaging with our content, you grant ROCKIN' the BOAT a non-exclusive, royalty-free, perpetual license to use, display, and distribute any content you submit in connection with our promotional activities.
3.1 Third-Party Cruise Lines: ROCKIN' the BOAT facilitates group cruises and provides early access to bookings. However, ROCKIN' the BOAT is not a cruise line, travel agency, or common carrier. All cruise bookings are subject to the terms, conditions, and cancellation policies of the respective cruise line (e.g., Carnival, Royal Caribbean, Norwegian, etc.).
3.2 Travel Disclaimer; Booking at Your Own Risk: ROCKIN' the BOAT connects cruisers and may share community information about group cruises and travel opportunities, but we do not control and are not responsible for the acts or omissions of cruise lines, airlines, hotels, venues, or other third-party providers. You acknowledge that travel involves inherent risks, and that schedules, pricing, itineraries, and availability may change at any time. ROCKIN' the BOAT is not responsible for itinerary changes, ship cancellations, weather delays, governmental actions, missed connections, supplier failures, or any travel-related issues. You book and participate at your own risk. We strongly recommend that all members purchase comprehensive travel insurance.
3.3 Local Events: Participation in local city events organized by ROCKIN' the BOAT is voluntary. Members assume all risks associated with attendance.
4.1 Product Availability: We offer cruise-themed merchandise for sale. All orders are subject to availability. We reserve the right to limit quantities or discontinue products at any time.
4.2 Payments: You agree to provide current, complete, and accurate purchase and account information for all purchases made via our Site. We use third-party payment processors to handle transactions securely.
4.3 Pricing and Shipping Costs: Prices, taxes (if applicable), and shipping costs are shown at checkout.
4.4 Refunds & Returns: Our merchandise is print-on-demand. Because each item is made specifically for you, we cannot accept returns or exchanges unless the product arrives damaged or defective. If you receive a damaged item, please contact us within 30 days of receipt with photos of the damage.
5.1 No Purchase Necessary: From time to time, ROCKIN' the BOAT may offer prizes through our video content and live streams. No purchase is necessary to enter or win.
5.2 Selection and Notification: Winners will be selected and notified according to the specific rules of each giveaway. ROCKIN' the BOAT reserves the right to disqualify any participant who tampers with the entry process.
5.3 Winner Selection at Our Discretion: Winners are chosen at our discretion based on the applicable contest or giveaway rules, including eligibility requirements, entry methods, deadlines, and selection criteria. Our decisions are final to the extent permitted by law.
5.4 Publicity: By accepting a prize, winners consent to the use of their name and/or social media handle for promotional purposes as outlined in our Privacy Policy.
6.1 Entertainment Purposes: Our YouTube videos, live streams, posts, and other content are provided for entertainment and general informational purposes only. We do not guarantee the accuracy, completeness, or usefulness of any content, and you rely on it at your own risk.
6.2 Our Rights: The Site and its original content, features, and functionality (including our logo, designs, videos, live stream content, and branding) are owned by ROCKIN' the BOAT and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly perform, or publicly display our content without our express written permission.
To the maximum extent permitted by law, ROCKIN' the BOAT and its owners shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Site, participation in group cruises, or purchase of merchandise. Our total liability to you for any claim arising out of these Terms shall not exceed the amount paid by you to ROCKIN' the BOAT in the 12 months preceding the claim.
These Terms shall be governed by and construed in accordance with the laws of the State in which ROCKIN' the BOAT is headquartered, without regard to its conflict of law provisions.
We reserve the right to modify or replace these Terms at any time. We will notify members of significant changes by posting the new Terms on the Site. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
